1. ACCEPTANCE OF TERMS

By creating an account, downloading, installing, or using the Mytharais mobile application ("Game" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Game. We recommend that you read these Terms carefully and retain a copy for your records.

2. ELIGIBILITY

You must be at least 13 years of age to create an account and use the Game. If you are located in a jurisdiction that requires a higher minimum age (such as 16 years in certain EU/EEA countries under GDPR), you must meet that age requirement. Users between 13 and the age of majority in their jurisdiction must have parental or guardian consent to use the Game. By using the Game, you represent that you meet these age requirements and, if applicable, have obtained the required consent.

3. ACCOUNT REGISTRATION

You agree to provide accurate, current, and complete information during registration and to keep such information updated. Each person may maintain only one account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must immediately notify us of any unauthorized use of your account. Mytharais is not liable for any loss or damage arising from your failure to protect your account credentials.

4. GAME RULES & CONDUCT

You agree to play fairly and abide by these rules of conduct:

• No cheating, botting, exploiting bugs, or using unauthorized third-party software
• No harassment, hate speech, bullying, or threatening behavior toward other players or staff
• No real-money trading (RMT) of in-game items or currency outside official Mytharais channels
• No impersonation of other users, staff, or entities
• No spam, unsolicited advertising, or disruptive behavior in any game channel

Violation of these rules may result in warnings, temporary suspension, or permanent account termination. We reserve the right to enforce these rules at our sole discretion.

5. VIRTUAL ITEMS & CURRENCY

All virtual items, currency, and other in-game assets ("Virtual Goods") are licensed, not sold. You receive a limited, non-exclusive, revocable license to use Virtual Goods within the Game. Virtual Goods have no real-world value and cannot be exchanged for cash or other items of value outside the Game, except as explicitly permitted by Mytharais. We may revoke or remove Virtual Goods if you violate these Terms. Refunds are not provided for Virtual Goods that have been consumed, used, or otherwise expended.

6. PURCHASES & PAYMENTS

In-app purchases are generally final and non-refundable. By making a purchase, you agree to the pricing and terms displayed at the time of purchase. Subscription and package terms will be specified at the point of purchase. We may change pricing with reasonable notice where required by law. Refund requests are subject to the policies of the platform through which you made the purchase (Apple App Store or Google Play). Please contact the applicable platform for refund inquiries. Mytharais does not control platform refund policies.

7. INTELLECTUAL PROPERTY

All game content, including but not limited to text, graphics, logos, artwork, music, sound effects, and software, is owned by Mytharais or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any Mytharais content without our prior written consent. By submitting user-generated content (such as usernames, avatars, or in-game communications), you grant Mytharais a perpetual, royalty-free license to use, display, and distribute such content in connection with the Game. You may not reverse engineer, decompile, or disassemble the Game or attempt to extract its source code.

8. ACCOUNT SUSPENSION & TERMINATION

Mytharais reserves the right to suspend or permanently terminate your account at any time, with or without notice, for violations of these Terms or for any other reason at our discretion. You may appeal a suspension or termination by contacting support@mytharais.io. We will review appeals in good faith but are not obligated to reinstate any account. Upon termination, your right to access the Game ceases immediately. We may retain certain account data as required by law or for legitimate business purposes.

9. DISCLAIMERS

THE GAME AND ALL RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE. SCHEDULED MAINTENANCE MAY OCCUR WITH REASONABLE NOTICE WHERE FEASIBLE. FEATURES LABELED AS "BETA" OR "EXPERIMENTAL" ARE PROVIDED WITHOUT WARRANTY AND MAY CHANGE OR BE DISCONTINUED AT ANY TIME.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYTHARIS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF VIRTUAL GOODS DURING OUTAGES OR MAINTENANCE, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE GAME. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE GAME SHALL NOT EXCEED THE AMOUNT YOU PAID TO MYTHARIS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS (USD 100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. CHANGES TO TERMS

We may update these Terms from time to time. Material changes will be communicated with at least thirty (30) days notice where practicable, including in-game notifications and/or email to your registered address. Continued use of the Game after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Game and may request account deletion.

12. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mytharais operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Game shall be resolved in the courts of that jurisdiction, and you consent to the personal jurisdiction of such courts.
